SMS Privacy Policy

 Standard Privacy Policy for SkylightsNW SMS Opt In

1. Introduction / Scope 

We respect your privacy and are committed to protecting your personal information. This policy describes how we collect, use, disclose, and safeguard your information when you opt in to receive SMS/text messages from us. It also describes your rights under applicable law, including Oregon’s new privacy law. 

2. Definitions 

“You” / “your” / “consumer”: an individual in Oregon who opts in to receive SMS messages. 

“Personal Data” / “Personal Information”: Information about you that is linked or reasonably linkable to you (e.g. phone number, name, etc.). 

“Sensitive Data”: Under the Oregon Consumer Privacy Act (OCPA), certain categories of data (e.g. biometric data, health information, geolocation, etc.) which require heightened protections. 

“Controller”: The entity determining the purposes and means of processing your personal data. 

“Processor”: An entity processing personal data on behalf of the controller. 

“Opt-In” / “Consent”: Your affirmative, clear, and unambiguous agreement to receive SMS messages. 

3. What Information We Collect 

When you opt in, we may collect: 

● Your mobile phone number 

● Your name (if provided) 

● Time / date of opt-in 

● Preference or categories you selected (e.g. offers, alerts) 

● Metadata (e.g. device type, carrier) We limit collection to what is necessary for delivering SMS content and managing the program. 

4. Purpose of Use 

We use your information to: 

● Send SMS/text messages you have agreed to receive (promotional messages, transactional alerts, reminders, etc.) 

● Manage, monitor, or improve our SMS program (e.g. scheduling, analytics) 

● Process your unsubscribe / opt-out requests 

● Comply with legal obligations 

We will not use your data for purposes incompatible with those disclosed to you at opt-in. 

5. Consent / Opt-In and Affirmative Consent 

By opting in, you affirmatively consent to receive SMS messages from us at the mobile number you provide. You acknowledge that consent is not a condition for purchase (unless allowed by law), and that messaging rates may apply under your carrier plan. 

For Oregon, under OCPA and related law, processing of sensitive data requires separate opt-in. 

6. Message Frequency, Timing, and Limitation 

We will provide you clear information about message frequency (e.g. “You will receive 3 messages per week”). 

We will not send SMS messages outside of 8 a.m. to 8 p.m. local time, unless an established business relationship allows otherwise. (Oregon’s HB 3865 expands text messages into “telephone solicitation” rules and restricts contacting outside 8 a.m.–8 p.m. absent such a relationship.) 

We will not send more than 3 solicitations in a 24-hour period, unless an established business relationship exists. 

7. Opt-Out / Revocation of Consent 

You may withdraw consent at any time (i.e. opt out). To opt out, reply with a simple and clear command such as “STOP”, “QUIT”, “UNSUBSCRIBE”, or “CANCEL.” 

We will honor opt-out requests within 10 business days

After receiving your opt-out, we may send a single confirmation message, but only if sent promptly (within ~5 minutes). 

8. Disclosures and Sharing 

We will disclose which third parties (processors or service providers) we share your data with, including what they do (e.g. SMS gateway, analytics). 

We will provide a list of third party categories and, to the extent possible, how they process data, in our privacy notice. (OCPA requires disclosing to which third parties personal data is disclosed and how they process it.) 

9. Consumer Rights under Oregon Law 

Under the Oregon Consumer Privacy Act (effective July 1, 2024) and related rules: 

● You may request confirmation whether we are processing your personal data, and obtain a copy. 

● You may correct inaccurate data. 

● You may request deletion of your personal data (subject to exemptions). 

● You may opt out of “sale” of your personal data, targeted advertising, or profiling. 

● You have the right to appeal if your request is denied; the controller must respond to appeals within 45 days. 

● We must respond to requests within 45 days (with possible 45-day extension, with notice). 

● We must not discriminate against you for exercising these rights (e.g. by reducing or altering service). 

● We must recognize universal opt-out preference signals starting January 1, 2026. 

10. Data Security 

We will maintain reasonable administrative, technical, and physical safeguards to protect your personal data against unauthorized access, disclosure, or destruction. 

When using de-identified data, we will take reasonable steps to ensure it cannot be re-identified. 

11. Retention 

We retain your personal data only as long as needed to fulfill the SMS program purposes, comply with legal obligations, resolve disputes, or for legitimate business reasons. After that, we will securely delete or anonymize it. 

12. Children’s Data 

We do not intentionally collect data from children under 13. Any data of minors 13–15 used for targeted advertising or profiling requires affirmative opt-in. 

13. Updates to Policy 

We may update this policy over time. When making changes, we will post a revised date at the top and notify you (e.g. via SMS, email, or our website) if materially different.
